This is an English translation provided for convenience. The Portuguese version, available at bravecare.pt/termos, is the original and legally binding version of these Terms and Conditions under Portuguese law.
1. Purpose and Acceptance of these Terms
These Terms and Conditions of Use govern access to and use of the website www.bravecare.pt, owned and operated by Brave Care, Unipessoal Lda. ("Brave Care" or the "Company"). The website is purely informational and institutional in nature, intended to publicise Brave Care's activity and its home nursing and healthcare services, and to provide a means of contact for information or quote requests.
Using the website implies full and unreserved knowledge and acceptance of these Terms and Conditions. If the user does not agree with these Terms and Conditions, they should refrain from using the website.
These Terms and Conditions do not, by themselves, constitute a contract for the provision of healthcare services, which will always be the subject of a separate, specific agreement between Brave Care and the relevant client or patient, following prior contact and an assessment of their actual needs.
2. Identification of the Responsible Entity
Under Article 10 of Decree-Law no. 7/2004, of 7 January, as currently in force, and for all other legal purposes, the entity responsible for the website is identified as:

3. Scope of the Services Publicised
Brave Care provides home nursing and healthcare services through a team of nurses who carry out their activity in strict compliance with the legal, ethical and regulatory standards applicable to the nursing profession, namely those issued by the Portuguese Nurses' Association (Ordem dos Enfermeiros).
The information provided on the website about the services offered is of a general nature and does not replace a prior, individualised clinical consultation and assessment of each situation, to be carried out before contracting and providing any care.
The website also provides direct links to Brave Care's contact channels and social media, namely WhatsApp, email, Instagram, TikTok and Facebook. By using these links, the user starts interacting directly with the relevant application or social network, subject to its own terms of use and privacy policy, over which Brave Care has no control.
4. Informational Nature of the Content — No Clinical Advice
The content available on the website is purely informational and promotional in nature, and does not, under any circumstances, replace the clinical assessment, diagnosis or advice provided by a healthcare professional in the context of an actual consultation or intervention.
In a medical emergency, the user should immediately contact emergency services (112) or go to a health facility, and should never wait for a response through the website or the contact channels provided on it.
5. Conditions of Use of the Website
The user undertakes to use the website diligently, lawfully and in accordance with these Terms and Conditions, applicable law and public order, refraining in particular from:
- Using the website for fraudulent, unlawful purposes or purposes that harm third-party rights;
- Introducing or spreading computer viruses or any other systems liable to damage the website, or Brave Care's or third parties' computer systems;
- Attempting to access restricted areas of the website or Brave Care's computer systems without authorisation;
- Reproducing, copying, distributing or commercially exploiting, in whole or in part, the website's content without Brave Care's prior, express authorisation.
Brave Care reserves the right, at any time and without prior notice, to suspend, limit or change access to the website, in whole or in part, namely for maintenance, security or content-update reasons.
6. Intellectual Property
All content available on the website, including, without limitation, text, images, logos, trademarks, graphics and other elements, is the property of Brave Care or third parties who have authorised its use, and is protected under national and international intellectual and industrial property law.
Reproduction, distribution, adaptation or public communication, in whole or in part, of this content, for commercial or other purposes, is prohibited without Brave Care's prior written authorisation.
7. Contact Form and Information Requests
The website provides a contact form intended exclusively for sending information requests, clarifying questions or requesting a quote, and under no circumstances constitutes the immediate or automatic contracting of any service.
Where a submitted request relates to the provision of nursing or healthcare services, the form may collect data on the patient's health status, clinical situation or care needs, which constitutes a special category of personal data under Article 9 GDPR. Collecting this data always depends on the explicit, informed and freely given consent of the data subject (or their legal representative, where applicable), given when the form is filled in, as described in Brave Care's Privacy Policy.
Any contracting of home nursing or healthcare services will always be preceded by direct contact between Brave Care and the interested party, with an assessment of actual needs, and formalised in a separate document setting out the specific terms of the service, including price, frequency and other applicable conditions.
Brave Care undertakes to respond to contact requests submitted through the website as promptly as possible, without, however, guaranteeing a specific response time.
8. Personal Data Protection and Cookies
Personal data submitted by the user through the website's contact form, as well as data collected automatically while browsing, is processed by Brave Care, as data controller, in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 ("GDPR"), and with Law no. 58/2019, of 8 August, which ensures the implementation of the GDPR under Portuguese law.
The website also uses cookies and similar technologies to ensure its proper functioning, measure its audience and, where applicable and subject to the user's consent, display marketing content or newsletter communications. The user can manage their cookie preferences through the consent banner shown on their first visit to the website and, at any time, through their browser settings.
More detailed information on the categories of data collected, the purposes and legal basis for processing, retention periods, data recipients, the cookie policy, and the data subject's rights (namely the rights of access, rectification, erasure, restriction, portability and objection) is set out in Brave Care's Privacy Policy, available on the website, which complements and forms part of these Terms and Conditions.
The website is not intended for the direct, independent collection of personal data from children under 13. Whenever a request for nursing care concerns a minor, the relevant personal and health data is only collected with the consent of the holder of parental responsibility or legal representative, under Law no. 58/2019, of 8 August.
9. Limitation of Liability
Brave Care makes every effort to ensure the accuracy, currency and continuous availability of the website's content and functionality, but cannot guarantee the absence of errors, omissions or technical interruptions. Brave Care is not liable for damages arising from: (i) unavailability, interruption or technical malfunction of the website; (ii) improper use of the website, or use contrary to these Terms and Conditions, by the user; (iii) decisions made by the user based solely on general information contained on the website, without a prior, individualised clinical assessment.
10. Links to Third-Party Websites
The website may contain links to other websites operated by third parties. The existence of these links does not imply any relationship of control, association or liability on Brave Care's part regarding the content, availability or practices of such websites, and Brave Care assumes no liability in that respect.
11. Changes to these Terms
Brave Care reserves the right, at any time, to change or update these Terms and Conditions, whenever this is considered necessary or appropriate, namely due to legislative changes or the evolution of the services provided. Changes take effect from the moment they are published on the website, so users are encouraged to review these Terms and Conditions periodically.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law. The courts of the district (comarca) of Lisbon have exclusive jurisdiction to resolve any disputes arising from the interpretation, validity or performance of these Terms, with express waiver of any other jurisdiction.
Under Law no. 144/2015, of 8 September, users are also informed that, in the event of a consumer dispute, they may turn to an alternative consumer dispute resolution body, namely the Lisbon Consumer Conflict Arbitration Centre, or consult the Consumer Portal (www.consumidor.gov.pt) for further information.
